There are ways to weasel out of everything as long as a company is big and powerful enough, and the government feels it is in their interest to look the other way as well. That is often the trade, do what we tell you, carry water for us and you will be protected and can do whatever else you want.
Gen AI is still a broken technology, and a lot of the overbroad fear mongering is really just a way to cover for what underneath it all is a broken technology. It is an attempt to make the technical failings sound exotic, when the tech is really dumb and just follows its programming with brute force and hallucinates while doing so:
